MANDATE OF THE DEPARTMENT:
To deliver the UNAIDS mandate and provide leadership and guidance to national partners and the UN system in reaching Global AIDS targets as part of the Sustainable Development Goals, the UNAIDS Secretariat counts on a capable and highly qualified workforce that is multi-skilled, diverse, mobile and able to work across disciplines. Within the Management and Governance Branch (MER), the Department of Human Resources Management (HRM) ensures that human resources are aligned with organizational strategy and priorities. The work of the Department is based on effective policies and services for organizational development, performance, staff support security, and HQ building management.

Located within HRM, the HR Policy and Legal Unit is responsible for the development of UNAIDS' human resources management policies reflecting organizational needs and best practice, and providing advisory services to the Organization, with a view to ensuring consistent and equitable policy application. The Unit also provides legal support and advice in HR operations and implementation of legally sound human resources management across the Organization ensuring adherence to Staff Regulations and Rules. The Unit is responsible for handling the Administration's response to requests for administrative review, appeals before the Global Board of Appeal, provision of legal support and advice in other informal and formal dispute resolution processes (e.g.. Global Rebuttal Panel, Classification Review Standing Committee). The Unit provides policy and legal advice on all HR issues, including in relation to compliance, conduct, and discipline of staff.
Main tasks and Responsibilities of the Position:
Under the direct supervision of the Chief of Human Resources Policy and Legal, the incumbent will perform the following tasks:

1. Prepare and provide legal and policy advice to HRM colleagues and UNAIDS staff on the interpretation and application of Staff Regulations and Rules, policies and related provisions regarding all areas of personnel administration, including in complex and highly sensitive matters.
2. Advise on issues related to complaints about and questions on alleged acts of misconduct by personnel.
3. Draft, research, review and prepare relevant documentation related to disciplinary matters.
4. Identify situations and cases amenable to informal resolution and/or settlement, provide legal support and advice to HRM and the Organization within informal dispute resolution processes.
5. Prepare the Administration's responses to requests for Administrative Review and appeals before the WHO Global Board of Appeal.
6. Provide legal support to the Secretariat of the Global Rebuttal Panel and Classification Review Standing Committee as well as other formal review bodies.
7. Draft, review, advise and prepare responses to legal inquiries and correspondence.
8. Conduct legal research and provide detailed analysis of legal precedents from the jurisprudence of the ILO Administrative Tribunal (ILOAT) cases and related case law.
9. Maintain and keep up to date the relevant databases on legal case management and registers on policy
10. Research and prepare comprehensive reviews and analysis on HR-policies and legal matters, incl. on best HR practices within the United Nations common system and other international organizations.
11. Develop and assist in the preparation of HR-related policies, instructions, briefing and information notes and other administrative issuances, reflecting organizational needs, best practice and WHO legal framework.
12. Review policies and procedures and recommend changes as may be required.
13. Advise and support the Organization in ensuring UNAIDS HR-related policies are applied correctly, consistently and in compliance with the Staff Regulations and Rules, policies and procedures.
14. Keep abreast of topics related to inter-agency HR policy development. Prepare and draft responses to inter-agency queries on HR policies and procedures.
15. Carry out other duties as assigned or required.
REQUIRED QUALIFICATIONS
Education:
Essential: Advanced university degree at the Master's level in law. Qualifications in international public law, law of international organizations, national or international administrative and labour law, human resources management, arbitration, business administration. For internal candidates, a first level university degree in law and 9 years of relevant professional experience may be considered as equivalent.

Desirable: Knowledge of human resources management theories and principles of staff management. Studies in litigation and advocacy, dispute resolution, mediation, ethics and/or compliance.

Experience:
Essential: A minimum of seven years of relevant professional experience in international administrative law, dispute resolution and litigation, human resources management and HR-policies development and implementation, with international exposure. Experience in the interpretation and application of staff regulations and rules, with administrative law and/or administrative tribunal(s) is required.

Desirable: Experience working in human resources within the UN system or other international organizations; Experience in handling complex and highly sensitive legal matters; Experience in handing disciplinary proceedings.
Languages:
Essential: Advanced level of English and good working knowledge of French.

Desirable: Good working knowledge of another UN system official language will be an asset.

Annual salary: (Net of tax)
73,516 USD at single rate
Post Adjustment: 81.7 % of the figure(s) on the left side. This percentage is to be considered as indicative since variations may occur each month either upwards or downwards due to currency exchange rate fluctuations or inflation.
